12-24-08: An open letter to NIST regarding certification fraud
-- From Bev Harris: Many important stories have taken place recently, including the groundbreaking results from the Humboldt County Transparency Project, the findings in the Time Slice Project, and the very troubling death of key witness Mike Connell in an Ohio vote fraud lawsuit. These events are joined by the unfolding voting machine certification fraud story. Black Box Voting will be devoting considerable space to examining the many critical issues in voting rights beginning after the New Year. Unfortunately I am challenged right now with a difficult family emergency, and have had to step back from publishing new articles for a few weeks. I continue to monitor unfolding events and am communicating with other activists behind the scenes, as well as continuing my research. I will resume active reporting in early January.

Below you will find the transcript of a video -- and a link, so you can see for yourself. This video pertains to perhaps THE most important issue in election protection today, the RIGHT TO KNOW.

We will continue to run down pointless rabbit holes seeking election reform if we don't focus on the core issues. The truth is, it doesn't matter how secure or how accurate a voting system is, if the public does not have the right to know; every change in election procedures or legislation must be examined through the lens of whether it helps or hurts our right to know.

The right to know is built into the founding documents of our nation. It is especially important in the area of elections, because it is through elections that we exercise control over our government. The argumentation for right to know can be framed as follows:

- Government is the servant of the people, and not the master of them.

- The people, in delegating authority, do not give their public servants the right to decide what is good for the people to know and what is not good for them to know.

- We must remain informed so that we may retain control over the instruments of government we have created.

- When we lose the ability to control, we lose our sovereignty over our own government and we no longer have a democratic form of government.

11-25-08: The mysterious disappearing candidate in Florida
A volunteer here, John Howard showed us all how to automate the collection of "time slice" data on Election Night. This information is in the Black Box Voting Tool Kit 2008, pp 47-51. I have been analyzing some of this time slice data and will release a report on some of my observations, probably a few reports.

But here's a spreadsheet that shows just how useful the time slice information can be. It produces almost like a "video" of the incoming vote flow.

The black type is original data. The purple is calculations on the accumulated totals, showing undervotes etc. The green is calculations which split out the data to show what happened in each time segment.

Now, what's entertaining about the spreadsheet I've linked above (which is for Broward County, State House Dist 112) is this: It shows 28 time slices, beginning just after the polls close and continuing until Nov. 15. Votes are flowing in, for two candidates -- Rivera and Gaffney -- and write-ins. It shows which votes are Election Day, Early, and Absentee, by precinct, and what time each set is uploaded, as well as the vote totals per candidate, vote category, precinct, and upload time.

Notice something very interesting: On Nov. 7 as of 2:47 in the afternoon, all the votes for all candidates disappear. Huh?

10-16-08: New results middleman spotted - FL, KS, IL, CA, CO, NC, SC, NY, NM, TX
The following locations are using software and, in some cases, hosting voter registration data and results on the servers that belong to a Florida company called SOE Software: (CA) Contra Costa, Los Angeles, San Diego, Santa Clara, Shasta, Ventura; (CO) Arapahoe; (FL) Broward, Duval, Hillsborough, Miami-Dade, Pasco, Palm Beach, St. Lucie; (IL) DuPage, McHenry, Lake; (KS) Johnson; (NC) North Carolina Board of Elections; (NM) Dona Ana, (NY) New York State Board of Elections; (SC) South Carolina State Election Commission; (TX) Dallas, Tarrant, Williamson.

The Tampa, Florida firm produces the "Clarity" software suite used with Hart Intercivic and also announced an alliance with Diebold to integrate its software. Here is the company Web site:

10-8-08: ELECTION ALERT - Avoid the 'Straight Party' vote stealing trap
You may have read about this, and Black Box Voting has sent an ELECTION ALERT about this. Here are the details and what to do about it:

THE PROBLEM: "Straight party voting" on voting machines is revealing a bad pattern of miscounting and omitting your vote, especially if you are a Democrat.

Most recently (Oct. 2008), a firm called Automated Election Services was found to have mis-coded the system in heavily Democratic Santa Fe County, New Mexico such that straight party voters would not have the presidential vote counted.

Straight party voting is allowed in 15 states. Basically, it means that you can take a shortcut to actually looking at who you are voting for and instead just select a party preference. Then the voting machine makes your candidate choices, supposedly for the party you requested.

Additional details follow, but first: PROTECT THE COUNT

1) NEVER CHOOSE THE STRAIGHT PARTY VOTE OPTION, because it alerts the computer as to your party preference and allows software code to trigger whatever function the programmer has designed.

2) SEND THIS INFORMATION OUT TO AS MANY PEOPLE AS YOU CAN, blog it, root n' toot it out there to get the word out.

3) ESPECIALLY GET THE WORD OUT TO PEOPLE IN THE FOLLOWING STATES, which have straight party voting options:

- Iowa
- Kentucky
- Michigan

9-21-08: Excruciating issues with voter list database

THE TWO HALVES OF HAVA

The second half of the Help America Vote Act (HAVA, perhaps more accurately termed the "Help Yourself to America's Vote Act") is just now kicking into play nationwide.

THE FIRST HALF OF HAVA strong-armed local elections jurisdictions into buying tamper-friendly voting machines.

THE SECOND HALF OF HAVA involves nationwide implementation of mandated, centralized tamper-friendly voter list databases at the state level.

WITH COMPUTERS, 'FIXES' CAN CAUSE NEW THINGS TO BREAK

The news coming out of Wisconsin provides a good illustration for how to break a system by fixing it.

Wisconsin engaged the services of Accenture to develop its centralized statewide voter database. Records obtained by Black Box Voting in 2006 revealed significant problems with the database in the midst of the November general election. Just days before the election, emergency troubleshooting was being performed, and days after the election, the system was shut down for repairs:

Now, you may think "That was in 2006, why worry in 2008?" Now look again at the dates. Major issues were being resolved Oct. 31 and Nov. 1, right before the election, and these records didn't come to light until AFTER the election. Wisconsin was using the system in 2006; many other states will use the statewide databases for the first time in 2008.
